Participation Waiver & Release of Liability
Company: ABDT Investments trading as Hurling Hatchets
By participating in axe-throwing and any activities on the premises (the “Activities”), I acknowledge and agree to the following:
- Assumption of Risk. I understand the Activities involve inherent risks including, without limitation, impact injuries, slips, trips, falls, and contact with thrown objects. I voluntarily assume all such risks, whether foreseen or unforeseen.
- Release. I, on behalf of myself and my heirs, executors and assigns, hereby release and discharge ABDT Investments trading as Hurling Hatchets, its owners, directors, employees, contractors and agents from any and all claims, demands, causes of action, damages or liability arising out of or related to my participation in the Activities, except to the extent caused by gross negligence or willful misconduct that cannot be excluded by law.
- Indemnity. I agree to indemnify and hold harmless ABDT Investments trading as Hurling Hatchets from any claim brought as a result of my own acts or omissions, or my failure to follow safety instructions.
- Rules & Safety. I will follow all posted rules and the instructions of staff at all times, including but not limited to: wearing closed-toe shoes; only throwing when a lane is clear; never crossing the foul line until instructed; and never handling equipment while impaired.
- Health. I am physically able to participate and am not under the influence of alcohol, drugs, or medication that may impair my judgment or coordination.
- Minors. Where I am signing on behalf of a minor participant, I warrant that I am the parent or legal guardian and consent to their participation under these terms.
- Photography/Media. I consent to the reasonable use of photographs and videos taken during the Activities for promotional purposes. (You may withdraw consent at any time by notifying staff.)
- Governing Law. This waiver is governed by the laws of South Africa. If any provision is held invalid, the remainder will continue in full force.
- Acknowledgment. I have read and understood this waiver. I understand I am giving up certain legal rights by signing it.
